Many business owners/equipment owners buy used equipment to supplement their inventory. Although quality used equipment can be a very useful addition, it can also be detrimental to a company’s business risk if it is below standard or defective, potentially leading to liability post-accident, with the resulting OSHA citations, OSHA fines, and civil suits.

It’s important to know about ‘duty of care’ responsibilities. Owners of the equipment have onerous inspection responsibilities which need to be carried out by a ‘qualified person’.
